In addition, this site never asks a child for his/her full name, street address, email address, phone number or other personally identifiable information when just a "screen name", age or first name will suffice. When using the chat rooms, kids are again encouraged not to give out any personal information and are given specific rules about what is appropriate for a chat room. While ABC7, WBBJ-TV cannot control and is not responsible for what is discussed or posted in a chat room or on a bulletin board, ABC7, WBBJ-TV makes reasonable efforts to monitor the site and clean out postings, which may be deemed harmful or offensive. Sweepstakes and Contests

Sweepstakes, contests, games, and other promotions run on a ABC7, WBBJ-TV site may require the user to provide some personally identifiable information to participate such as full name, address, email address, phone number and cable system/cable channel on which the user watches ABC7, WBBJ-TV. Children under 13 are encouraged to ask permission and obtain consent from a parent before entering a contest. Children will be told; in easy to understand language, exactly why the information is required.

In order for a child who wins a ABC7, WBBJ-TV contest to receive a prize, he/she must submit a signed parental release and affidavit ABC7, WBBJ-TV giving ABC7, WBBJ-TV  to send the gift. All prizes are sent to the parents and not to the child directly.

Chat Rooms, Bulletin Boards and Submissions

ABC7, WBBJ-TV may also obtain information from a user when he/she logs on to a chat room, posts a bulletin board, sends in an idea and a number of other activities. Once again, children are encouraged to ask a parent for permission to use any of these features of the site. Children are also encouraged to use a "screen name" or their initials instead of their real name, and no last names and/or street addresses are ever required to participate. IP Addresses

ABC7, WBBJ-TV may collect and disclose non-personal user information (for example, IP addresses) in aggregate form. An IP address is a number given to a user by a Web server. Users Agreement and Rules of Conduct

b. Participant shall not upload, post or otherwise make available on the ABC7, WBBJ-TV site any material protected by copyright, trademark or other proprietary right without the express permission of the owner of such copyright, trademark or other proprietary right.
c. Participant hereby waives any and all rights to any stories, ideas, drawings, opinions, and other creative "materials" posted to the ABC7, WBBJ-TV site. Participant authorizes ABC7, WBBJ-TV to utilize, in any manner it sees fit and for eternity, the materials posted on the site, which shall become the property of ABC7, WBBJ-TV. Participant releases ABC7, WBBJ-TV from any and all claims or liability in connection therewith, and agrees to indemnify ABC7, WBBJ-TV in connection therewith pursuant to the terms in paragraph 3 below. Participant agrees and acknowledges that participation in the ABC7, WBBJ-TV site shall not give rise to any confidential, fiduciary, implied-in-fact, implied-in-law, contractual or other special relationship between Participant and ABC7, WBBJ-TV (other than the contractual relationship between ABC7, WBBJ-TV and Participant entered into by virtue of Participant's agreement to these Rules of Conduct.)

2. Rights of ABC7, WBBJ-TV /Disclaimer of Liability

d. ABC7, WBBJ-TV is a distributor only (and not a publisher) of ABC7, WBBJ-TV chat room and bulletin board content, which is supplied by Participant with occasional responses from ABC7, WBBJ-TV. ABC7, WBBJ-TV shall not be responsible for policing, monitoring, or editing such content, exercises no more editorial control over such content than would a public library, bookstore, newsstand, or other distributor of content, and accordingly, shall not be responsible for exercising editorial control over such content. Notwithstanding the foregoing, ABC7, WBBJ-TV shall have the right, but no the obligation, to monitor such content in order to respond to or comment upon communications by Participants and in order to determine compliance with the Rules of Conduct. ABC7, WBBJ-TV shall have the right and sole discretion to edit, to refuse to port or to remove any content whatsoever which it finds to be in violation of the provisions hereof or which it finds in its sole discretion to be otherwise objectionable for any reason. The opinions expressed in the chat rooms and bulletin boards are not necessarily (and in some cases not at all) those of ABC7, WBBJ-TV. ABC7, WBBJ-TV is not responsible for any materials provided by users, which are deemed harmful or offensive to others. ABC7, WBBJ-TV is not responsible in any way for any injury, loss or damage, which occurs as a result of an opinion expressed or information, provided in these sections of the site.

e. ABC7, WBBJ-TV has established relationships with reputable business partners that allow visitors to our site to link directly to sites operated by these partners. Some of these sites may be branded or co-branded with a ABC7, WBBJ-TV logo; however, they are not operated or maintained by ABC7, WBBJ-TV or its affiliated companies. 3. Participant's Indemnification/Obligations

Participant agrees to defend, indemnify and hold harmless ABC7, WBBJ-TV, its parent, subsidiary and affiliated companies and their respective directors, officers, employees and agents from and against all claims, losses, costs and expenses (including attorney's fees) arising out of Participant's use of ABC7, WBBJ-TV sites, or arising out of any violation of these Rules of Conduct by Participant including, without limitation, any communication by Participant which is claimed to be defamatory, obscene or otherwise unlawful, which is claimed to violate the copyright, trademark, proprietary or other rights of third parties, or which constitutes a submission of materials.

4. Termination

ABC7, WBBJ-TV shall have the right to immediately terminate any Participant's use of the ABC7, WBBJ-TV site if ABC7, WBBJ-TV determines in its sole discretion that Participant has violated the Rules of Conduct set forth herein or otherwise breached this agreement, or has engaged in conduct which ABC7, WBBJ-TV determines in its sole discretion to be unacceptable.

5. Miscellaneous

This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof and supercedes all prior or contemporaneous written or oral agreements between the parties with respect to the subject matter hereof. This Agreement shall be construed in accordance with the laws of the state of South Carolina, and parties consent to the jurisdiction of the courts in the district, without regard to its conflict of laws rules.

This site is governed by a Privacy Policy, which can be found herein. Some sections of the site may have additional privacy practices, which are described in detail at those specific locations. ABC7, WBBJ-TV reviews its Privacy Policies periodically and reserves the right to make revisions at any time. FOX ABC7, WBBJ-TV encourages parents and children to review the Privacy Policy often for changes. Participant's continued use of the site after a change has been made to the policies of the site implies Participant's assent to those changes.

The ABC7, WBBJ-TV site contains neither expressed nor implied warranties for use. ABC7, WBBJ-TV does not warrant that the site will be without viruses or defects, and ABC7, WBBJ-TV is not responsible for any repair or maintenance visitor's system may require as a result of using the ABC7, WBBJ-TV site.
